The Notary Pay is a payment technology platform operated by NotaryPay Technologies LLC ("we," "us," "our"). We enable notaries and signing agents ("you," "users") to accept credit and debit card payments from their clients. Payment processing and the movement of funds are provided by our registered third-party processing partner. We are not a bank and do not provide legal services.
To use The Notary Pay, you must be a commissioned notary or signing agent in the United States, be at least 18 years old, and provide accurate registration and identity information as required by our processing partner for verification (KYC/KYB).
We charge a per-transaction fee of 3.5% + $0.30 on each card charge, unless otherwise agreed in writing. There are no monthly fees or setup costs. Fees are deducted automatically from each transaction. The fee may change with reasonable notice.
When your client pays, funds are settled to your designated bank account by our processing partner, typically within one to two business days. We do not take custody of your funds. Payout timing may vary based on the processor, your bank, and verification status.
If a client disputes a charge, the amount may be reversed and debited from your account, along with any applicable dispute fees, in accordance with card network rules and our processing partner's procedures. You are responsible for chargebacks and disputes arising from your transactions. We will notify you and provide the information needed to respond.
You agree to use the service lawfully, to charge only for legitimate services you provide, to keep your account information accurate, and not to use the service for any fraudulent, illegal, or prohibited activity. You are responsible for any taxes on your income.
Card data is processed and secured by our processing partner using bank-level encryption. You never store or handle raw card data. You are responsible for keeping your own account credentials secure.
You may stop using the service at any time. We may suspend or terminate your account if you violate these Terms, engage in fraudulent or high-risk activity, or as required by our processing partner or applicable law.
To the maximum extent permitted by law, The Notary Pay and NotaryPay Technologies LLC are not liable for indirect, incidental, or consequential damages, or for issues arising from the processing partner, banks, or card networks. The service is provided "as is."
We may update these Terms from time to time. Continued use of the service after changes take effect means you accept the updated Terms.
